I, the undersigned, am the parent or legal guardian of my child.

 

The Player has been given the opportunity by Atherton Hockey LLC in partnership with VG Hockey LLC to participate in youth ice hockey on-ice training sesssions.

I fully understand and acknowledge that participating in ice hockey is an activity that has its own unique risks, including without limitation strains, sprains, cuts, bruises, concussions, broken bones, and injuries from being struck by sticks, pucks, skates or other players, injuries from running into boards, nets, or equipment, and injuries arising from ice conditions. I further understand and acknowledge that serious injury or even death could result from participating in on ice training activities through no fault of the Player.

 

The Player is voluntarily choosing to participate in on ice training, with my consent and approval. By signing below, and in consideration of the opportunity granted to the Player to participate in Atherton Hockey or VG Hockey on ice training activities, and for other valuable consideration, the receipt and adequacy of which are hereby acknowledged, I hereby on behalf of myself and on behalf of the Player and the Player’s heirs, personal representatives, successors and assigns (collectively, “Heirs and Assigns”), act and expressly agree as follows:

 

I HEREBY CONSENT TO AND APPROVE OF THE PLAYER’S PARTICIPATION IN ATHERTON HOCKEY AND VG HOCKE ON ICE TRAINING ACTIVITIES. I HEREBY ASSUME THE ENTIRE RISK OF ANY ACCIDENTS OR PERSONAL INJURY, INCLUDING DEATH, THAT THE PLAYER MIGHT SUFFER AS A RESULT OF PARTICIPATING IN ON ICE TRAINING ACTIVITIES. 

 

Without limiting the foregoing, I ASSUME ALL RISKS ARISING FROM THE FOLLOWING: (i) On ice practices and games and related activities; (ii) the condition or safety of the ice, athletic facilities and property at or on which on ice training activities are conducted, and the condition or safety of equipment used in those activities; (iii) the repair or maintenance, or lack thereof, of the ice, athletic facilities, property and equipment on, at or with which on ice training activities are conducted; (iv) the use of, or failure to use, any safety devices or safeguards; (v) the conditions, qualifications, instructions, coaching, rules or procedures under which any on ice training activities are conducted; (vi) and travel to and from on ice training activities.

 

Additionally, on behalf of myself, the Player and the Player’s Heirs and Assigns, I hereby RELEASE AND FOREVER DISCHARGE Atherton Hockey LLC and VG Hockey LLC  and each of Atherton Hockey LLC and VG Hockey LLC volunteer coaches and assistants (collectively, the “Released Parties”), from ANY AND ALL NEGLIGENCE, BREACH OF WARRANTY AND OTHER CLAIMS, DEMANDS, RIGHTS AND CAUSES OF ACTION OF ANY KIND WHATSOEVER that I or the Player or the Player’s Heirs and Assigns now have or later may have against any Released Party resulting from, connected with or arising out of the Player’s participation in on ice training activities.

 

This Agreement does not, however, release any claims for harm caused by a Released Party intentionally or recklessly.

 

I understand that Atherton Hockey LLC, VG Hockey LLC and the training facilities do not provide medical or other insurance to the Player.

 

I confirm that this Agreement is intended to be as broad and inclusive as is permitted by law. To the extent that the scope of this Agreement is unenforceable in any jurisdiction, said scope will, as to such jurisdiction only, be automatically limited to the extent necessary to make this Agreement enforceable in such jurisdiction, without invalidating any other portion of this Agreement. I acknowledge I have the right and opportunity to negotiate the terms of this Agreement, and I hereby waive such right. I understand that by choosing voluntarily to sign below I am giving up important legal rights on my behalf and on behalf of the Player and the Player’s Heirs and Assigns. By signing this Agreement, I certify that I have read this Agreement and fully understand it, that I am not relying on any statements or representations of any of the Released Parties, and that I have been given the opportunity and sufficient time to read and ask questions regarding this Agreement. This Agreement sets forth the entire agreement between me, Atherton Hockey LLC, and VG Hockey LLC regarding the topics addressed herein, and may only be modified or terminated with the written consent of me, Atherton Hockey LLC, and VG Hockey LLC.
